How We Use Your Information
Golding Health and Education collects and uses personal information to respond to enquiries, provide information about our services, arrange and deliver ADHD assessments and autism assessments, communicate with clients and their families, prepare assessment reports, and manage our services.
We only collect and use information that is relevant and necessary for the purpose for which it is being processed.
Website and General Enquiries
When you contact us through our website, by email, telephone, or another method, we may collect information such as your name, contact details, and the information you provide about your enquiry.
We use this information to:
- respond to your enquiry;
- provide information about our ADHD assessments and autism assessments services;
- answer questions about our services, fees, and availability;
- communicate with you about your enquiry;
- take steps at your request towards arranging an assessment or other service; and
- maintain appropriate records of enquiries and communications.
For general enquiry information, our lawful basis for processing is legitimate interests, as we have a legitimate interest in responding to people who contact us and managing enquiries made to Golding Health and Education. Where you ask us to take specific steps before entering into a contract or receiving a service, we may also rely on taking steps at the request of the individual prior to entering into a contract, where this is the appropriate lawful basis for the particular processing.
Our general enquiry form is not intended to collect detailed medical, diagnostic, or other special category information. We therefore ask you not to include detailed health information unless it is necessary for your enquiry.
Information Collected for an Assessment
If you decide to proceed with an ADHD assessment or autism assessment, we will need to collect additional information to arrange and undertake the assessment and prepare the relevant assessment documentation and report.
This information may include:
- personal and contact information;
- information about the individual being assessed;
- developmental history;
- educational information;
- medical and health information;
- information relating to ADHD, autism, or other neurodevelopmental conditions;
- information about mental health and wellbeing where relevant to the assessment;
- information provided by parents, carers, or other individuals involved in the person's care or education;
- relevant reports, records, or supporting documentation; and
- information obtained during the assessment itself.
Some of this information constitutes special category personal data, particularly information concerning physical or mental health. Before an assessment takes place, we provide an Assessment Consent Form, which explains the assessment process and asks the relevant individual, parent, or person with appropriate authority to provide the required consent.
Where we rely on explicit consent as the Article 9 condition for processing special category information, the consent will specifically identify the processing and the type of special category information involved. Consent will be obtained through a clear affirmative statement and recorded by Golding Health and Education. The consent obtained for the assessment is separate from consent for optional activities such as marketing and does not replace the privacy information provided in this Privacy Policy.
Lawful Basis for Assessment Information
For personal information processed in connection with an assessment, we will identify an appropriate lawful basis under Article 6 of the UK GDPR according to the particular processing activity.
Where we process special category information, we will also rely on an appropriate Article 9 condition and, where applicable, the relevant provisions of the Data Protection Act 2018. Where explicit consent is the appropriate Article 9 condition, this will be obtained through our Assessment Consent Form.
The fact that we obtain consent for the processing of particular special category information does not mean that consent is necessarily the lawful basis under Article 6 for every aspect of our processing. The applicable lawful basis depends on the purpose of the processing.
Withdrawal of Consent
Where processing is based on consent, you may withdraw your consent at any time by contacting us.
Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.
Where we rely on another lawful basis or Article 9 condition for particular processing, withdrawal of consent will not necessarily require us to stop that processing. If withdrawing consent would mean that we can no longer undertake an assessment or provide a particular service, we will explain this to you.
Information Relating to Children and Young People
When an assessment is being undertaken for a child or young person, we will take appropriate steps to establish who has the authority to provide consent and to make decisions about the processing of the child's information.
We recognise that children have their own data protection rights. We will consider the child's age, understanding, and circumstances when providing privacy information and communicating about their personal information.
Sharing Information
Information collected as part of an assessment may be shared with authorised members of the Golding Health and Education team and relevant professionals involved in providing the assessment, where this is necessary for the assessment or another stated purpose.
Where information is shared with parents, carers, schools, healthcare professionals, or other third parties, we will do so only where there is an appropriate lawful basis and, where required, an appropriate Article 9 condition or other legal basis for sharing. We will explain significant or planned information-sharing arrangements as part of the assessment process where appropriate.
Assessment Reports
Information collected during an assessment may be used to prepare an assessment report and associated documentation. Where a report is provided to a parent, carer, the person assessed, or another authorised individual, we will do so in accordance with the arrangements explained during the assessment process and our applicable legal and professional obligations.
Retention of Assessment Information
We retain assessment information for as long as is reasonably necessary for the purposes for which it was collected, including maintaining appropriate assessment and client records and meeting our legal, regulatory, professional, and insurance requirements. The retention period may therefore be longer than the period for which we retain a general website enquiry. Our retention schedule sets out the applicable retention periods for different categories of information.
Your Rights
Depending on the circumstances and the lawful basis on which we process your information, you may have rights under UK data protection law, including the right to:
- request access to the personal information we hold about you;
- ask us to correct inaccurate or incomplete information;
- request the erasure of your information in certain circumstances;
- request restriction of processing in certain circumstances;
- object to certain processing, including processing based on legitimate interests; and
- request transfer of certain information where the right to data portability applies.
Where we rely on consent, you also have the right to withdraw that consent. The availability of these rights depends on the circumstances and the lawful basis on which we are processing your information.
If you have any questions about how we use your information or wish to exercise your rights, please contact us at admin@goldinghealthandeducation.com. You also have the right to complain to the Information Commissioner's Office (ICO) if you believe that your personal information has been handled unlawfully.
